Going to the gym is just one way that many of us actively stay in shape. For a nominal fee. We have access to a variety of equipment, instructors, and classes that we otherwise wouldn’t have in our home gyms.

But while all this equipment makes it easy for us to get into shape, it also poses a risk of injury if we’re not careful or not entirely sure how to use the equipment.

So what happens if you are injured at the gym?

Are they held accountable?

Can you sue?

If you are ever in this situation, here are the 5 things to do if you hurt yourself at the gym.

Get your Facts Straight

In order for your claim against the gym to be viable, the gym needs to be at fault. In order to prove this, it’s very important for you to get your facts straight.

For instance, if you fell in the gym, the gym will not be liable if you were just clumsy. However, if you fell on a mopped floor that didn’t have a caution sign near it, then this creates liability on the gym.

Before you decide to move forward with any case, be sure you have your facts straight. Document anything you can in the moment, if possible. For instance, snap a picture of the water on the floor with no sign in sight.

Get witness names and phone numbers who are willing to testify on your behalf. Be sure to tell someone at the gym about what happened and ask for a report to be filled out (and get a copy). The more information you can gather to prove your story, the better your chances will be.

Some personal injury claims have a statute of limitation[1] against them, so you don’t want to wait too long after your injury to move forward.

Instead, be sure that you are time conscious about every decision you make and be sure you get documentation of doctor and hospital visits and bills to help move your claim forward. If you can do this all in a timely fashion, it can help you get the compensation you deserve.

Read the Fine Print

Usually, when you register for a gym membership you sign a waiver that says the gym isn’t liable if you were to injure yourself on their equipment or on their premises.

In some cases, this waiver can hold you back from getting any compensation from a gym injury. However, it’s still important to read the fine print and see exactly what it says.

After all, not all waivers cover everything, and your injury may be one of the loopholes not covered in this waiver. Be sure to go over the agreement you signed in detail and see if anything stands out to you.

See a Personal Injury Lawyer

If you want to take your case to trial or if you simply want to talk to someone to see if you have a case, then you’ll want to see a personal injury lawyer. These individuals are professionals in all injury cases and can help you determine if your case against the gym is valid.

According to fightingforyou.com, “A personal injury lawyer will take all the facts from your case and determine who is at fault. Should they assume there is a case, they will work with you to collect documents and information to get you the necessary compensation needed for your specific injuries.”

Instead of trying to go at this alone, it would be a good idea for you to at least talk to a personal injury lawyer and see if you have enough to make a solid claim.
